Status of the use of Medical Marijuana in Workers’ Compensation Currently through the controlled substance act of 1970s marijuana is still illegal at the federal level which does not include the 25 states who have legalized medical marijuana with 9 States in the previous election ballot. Recreationally: Arizona, California, Maine, Massachusetts, Nevada (all were passed except AZ) Medical use: Arkansas, Florida, Montana, North Dakota. All were passed however with Montana specifically this new law and its restrictions resulted with many work compensation carriers denying coverage of medical marijuana.
